حدثنا الحسن بن معروف، قال: حدثنا أبو بكر الأعْين، قال: حدثنا يحيى بن معين، قال: سمعت علي بن مُسهر، يقول: خرج الأعمش إلى الحج فشيعه أهل الكوفة وأنا فيهم، فلما أتى القادسية رأوه مغموماً، فقالوا له في ذلك، فقال: علي بن مسهر شيَّعنا؟ قالوا: نعم، قال: ادعوه لي، فدعوني وقد كان عرفني بمجالسة أبي حنيفة قال: ارجع إلى المصر وسَلْ أبا حنيفة بأن يكتب لي المناسك، فرجعت فسألته فأملى علي، ثم أتيت بها الأعمش.

Al-Ḥasan ibn Maʿrūf related to us. He said: Abū Bakr al-Aʿyan related to us. He said: Yaḥyā ibn Maʿīn related to us. He said: I heard ʿAlī ibn Mushir say: Al-Aʿmash left for pilgrimage. The people of Kufa accompanied him on his departure, and I was among them. When he reached al-Qādisiyya, they saw that he was troubled and asked him about it. He said: ‘Did ʿAlī ibn Mushir accompany us?’ They said: ‘Yes.’ He said: ‘Call him to me.’ They called me. He knew me through my sitting with Abū Ḥanīfa. He said: ‘Return to the city and ask Abū Ḥanīfa to write down the pilgrimage rites for me.’ I returned and asked him, and he dictated them to me. Then I brought them to al-Aʿmash.

حدثنا محمد بن القاسم البلخي، قال: حدثني محمد بن إسحاق الصغاني قال: حدثني سويد بن سعيد، قال: سمعت علي بن مسهر يقول: خرج الأعمش إلى الحج فشيعناه إلى القادسية، فوقع بينه وبين الجَمَّال خصومة بسبب الكِراء، فأحاكمه معه الكراء، وقال لي: ارجع إلى الكوفة فقل لأبي حنيفة حتى يكتب لي شرطاً على الجمّال ويستوثق منه وعجِّل علي، فرجعت وسألت أبا حنيفة بأن يكتب له ما سأل، فكتب أبو حنيفة واستوثق منه، فذهبت إلى القادسية فلم أجد الأعمش، فخرجت فلحقته بالثعلبية، ودفعت إليه الكتاب فسُرَّ به وأعجبه، وقال لي: إذا لقيته ـ يعني أبا حنيفة ـ فأقْرأه مني السلام.

He said: I heard Abū Muʿāwiya say: Our shaykhs used to give legal opinions with apprehension. When their opinion agreed with Abū Ḥanīfa’s, they were pleased. I said: ‘Who were they?’ He said: ‘Among them was al-Aʿmash.’

حدثنا زكريا بن يحيى بن الحارث النيسابوري، قال: حدثني أحمد بن محمد بن عبيدة، قال: حدثنا أبو إبراهيم إسماعيل بن يحيى المزني، قال: حدثنا علي بن معبد، عن عبيد الله بن عمر، عن الأعمش، أنه قال: يا نعمان! ما تقول في كذا؟ قال كذا، قال: من أين؟ قال: أنت حدثتنا عن فلان، عن فلان، قال الأعمش: يا معشر الفقهاء! أنتم الأطباء ونحن الصيادلة.

حدثنا محمد بن الحسن صاحب الأمالي ببلخ، قال: حدثنا بشر بن الوليد، قال: قال أبو يوسف رحمة الله عليه: لقيني الأعمش صاحبك هذا الذي يخالف عبد الله بن مسعود، قال: فقلت له: فيما يخالفه؟ قال: قال عبد الله بن مسعود: بيعُ الأمة طلاقُها، وصاحبك يقول: ليس بيع الأمة طلاقها، قال: فقلت له: أنت حدثتنا عن النبي ﷺ: أنه لم يجعل بيع الأمة طلاقها، قال: فقال لي: وأين حدثت ذلك، قال: قلت: حدثتنا عن إبراهيم، عن الأسود، عن عائشة رضي الله عنها: أن النبي عليه السلام خيّر بَريرة، قال أبو يوسف: فلو كان بيع الأمة طلاقها ما كان لتخييره معنى، لأن عائشة رضي الله عنها اشترتها، فلو كان بيعها طلاقاً ما خيرها النبي عليه السلام، قال الأعمش: يا يعقوب هذا في هذا؟ قلت: نعم.

Muḥammad ibn al-Ḥasan, the author of the dictated sessions in Balkh, related to us. He said: Bishr ibn al-Walīd related to us. He said: Abū Yūsuf, may God have mercy on him, said: Al-Aʿmash met me: ‘This companion of yours contradicts ʿAbd Allāh ibn Masʿūd.’ I said to him: ‘In what does he contradict him?’ He said: ‘ʿAbd Allāh ibn Masʿūd said: “The sale of an enslaved woman divorces her.” Your companion says: “The sale of an enslaved woman does not divorce her.”’ I said to him: ‘You related to us from the Prophet, peace and blessings be upon him, that he did not treat her sale as divorcing her.’ He said: ‘Where did I relate that?’ I said: ‘You related to us from Ibrāhīm, from al-Aswad, from ʿĀʾisha, may God be pleased with her, that the Prophet, peace be upon him, gave Barīra a choice.’ Abū Yūsuf said: If the sale of an enslaved woman divorced her, giving her a choice would have had no meaning. ʿĀʾisha, may God be pleased with her, bought her; if her sale were a divorce, the Prophet, peace be upon him, would not have given her a choice. Al-Aʿmash said: ‘Yaʿqūb! This applies to this?’ I said: ‘Yes.’

حدثنا أحمد بن محمد، قال: حدثنا أحمد بن عبد الملك القاضي، قال: حدثني أحمد بن مؤمل، قال: حدثنا علي بن صالح، عن أبي يوسف، قال: لقيني سليمان الأعمش، فقال لي: يا يعقوب! ألم تر إلى صاحبك أبي حنيفة يخالف عبد الله بن مسعود، قال: قلت في ماذا؟ قال: قال عبد الله: بيع الأمة طلاقها، وقال صاحبك: أنه لا يكون طلاقها، قال: قلت له: أنت حدثتنا عن رسول الله ﷺ: أن بيعها لا يكون طلاقها، قال: من أين؟ قلت: أنت حدثتنا عن إبراهيم، عن الأسود، عن عائشة رضي الله عنها: أنها اشترت بريرة وأعتقتها، وخيَّرها رسول الله ﷺ، فلو كان البيع طلاقاً لم يكن هاهنا خيار، قال الأعمش: أنتم سحّار، أنتم سحّار.

Aḥmad ibn Muḥammad related to us. He said: Aḥmad ibn ʿAbd al-Malik, the judge, related to us. He said: Aḥmad ibn Muʾammal related to me. He said: ʿAlī ibn Ṣāliḥ related to us, from Abū Yūsuf, who said: Sulaymān al-Aʿmash met me and said: ‘Yaʿqūb! Have you not seen your companion Abū Ḥanīfa contradict ʿAbd Allāh ibn Masʿūd?’ I said: ‘In what?’ He said: ‘ʿAbd Allāh said: “The sale of an enslaved woman divorces her.” Your companion says it does not divorce her.’ I said to him: ‘You related to us from the Messenger of God, peace and blessings be upon him, that her sale does not divorce her.’ He said: ‘On what basis?’ I said: ‘You related to us from Ibrāhīm, from al-Aswad, from ʿĀʾisha, may God be pleased with her, that she bought Barīra and freed her, and the Messenger of God, peace and blessings be upon him, gave her a choice. Had the sale been a divorce, there would have been no choice here.’ Al-Aʿmash said: ‘You are magicians; you are magicians.’

حدثنا أبو زيد عمران بن فرينام الضرير، قال: سمعت أبا عثمان أحمد بن خالد المروزي، يقول: عن بشر بن يحيى، عن جرير، قال: جاءت امرأة إلى الأعمش تسأله عن مسألة من الحيض، فقال: أين يعقوب حتى يفتي هذه؟ فجاء أبو يوسف فأفتاها، فقال الأعمش: يا يعقوب! أنعمان يعلمكم هذا؟ قال: نعم، قال: ما أحسن ما يعلمكم، قال: فرجعت المرأة فزادت في المسألة، فقال: أين يعقوب حتى يفتي هذه؟ فإنها قد زادت في مسألتها، قال: فجاء يعقوب، فأفتاها، فقال: يا يعقوب! أنعمان يعلمكم هذا؟ قال: نعم، قال: ما أحسن ما يعلمكم.

Abū Zayd ʿImrān ibn Firīnām, the blind man, related to us. He said: I heard Abū ʿUthmān Aḥmad ibn Khālid al-Marwazī say, from Bishr ibn Yaḥyā, from Jarīr, who said: A woman came to al-Aʿmash to ask a question concerning menstruation. He said: ‘Where is Yaʿqūb, so that he can give her an opinion?’ Abū Yūsuf came and answered her. Al-Aʿmash said: ‘Yaʿqūb! Does Nuʿmān teach you this?’ He said: ‘Yes.’ He said: ‘How well he teaches you!’ The woman returned and added something to the question. He said: ‘Where is Yaʿqūb, so that he can answer her? She has added to her question.’ Yaʿqūb came and answered her. He said: ‘Yaʿqūb! Does Nuʿmān teach you this?’ He said: ‘Yes.’ He said: ‘How well he teaches you!’

حدثنا أبي، ومحمد بن عبد الله بن سهل، قالا: حدثنا أبو عبد الله محمد بن أحمد بن حفص، عن بشر بن يحيى، عن جرير، قال: سمعت الأعمش جاءه رجل، فسأله عن مسألة، فقال: عليك بأهل تلك الحلقة، فإنهم إذا وقعت لهم مسألة لا يزالون يديرونها حتى يصيبوا، يعني حلقة أبي حنيفة وأصحابه رحمة الله عليهم وعلى الرواة المذكورين.

My father and Muḥammad ibn ʿAbd Allāh ibn Sahl related to us. They said: Abū ʿAbd Allāh Muḥammad ibn Aḥmad ibn Ḥafṣ related to us, from Bishr ibn Yaḥyā, from Jarīr, who said: I heard al-Aʿmash when a man came and asked him a question. He said: ‘Go to the people of that circle. When a question arises for them, they keep discussing it until they reach the right answer’—meaning the circle of Abū Ḥanīfa and his companions. May God have mercy on them and on the transmitters mentioned.
