حدثنا العباس بن حمزة النيسابوري، قال: حدثنا أحمد بن عيسى، قال: حدثني ابن وهب، قال: كان الليث يحدث عن يعقوب، عن النعمان، عن حماد، عن إبراهيم رحمة الله عليهم قال: إذا طلق الرجل امرأته وبينهما صبيٌ فالرضاع على الأب، ويكون عند الأم، وإن كانت الأم ترضعه بأجر بمثل ما ترضع غيرها فهي أحق به، وإن أرادت أكثر دفع إلى غيرها، قال يعقوب: وكان أبو حنيفة يقول به، ويقول أيضًا: لا أخرجه من يد الأم، وتتحوّل المرأة المرضعة حتى يكون عند الأم ما لم تتزوج الأم. قال الليث: ما أحسن ما قال.

al-ʿAbbas ibn Hamza al-Naysaburi related to us; he said: Ahmad ibn ʿIsa related to us; he said: Ibn Wahb related to me; he said: al-Layth used to relate from Yaʿqub, from al-Nuʿman, from Hammad, from Ibrahim, may God have mercy on them; he said: If a man divorces his wife and they have a young child, the father is responsible for nursing and the child stays with the mother. If the mother nurses him for a wage equal to that for which another woman would nurse, she has the greater right to him. If she wants more, he is given to another woman. Yaʿqub said: Abu Hanifa held this position and also said: I do not take him out of the mother's hands; the wet nurse moves so that he stays with the mother as long as the mother does not marry. Al-Layth said: How excellent his statement is!
