أخبرنا أحمد بن محمد، قال: حدثنا محمد بن عمرو بن عثمان الخزاز، قال: حدثنا أبي، قال: حدثنا علي بن الركين بن الربيع، عن أبيه، قال: كنت عند أبي حنيفة فسئل عن طلاق السكران، فقال: حدثني الهيثم الصيرفي، عن عامر وشريح، أنهما قالا: طلاق السكران جائز، فقلت له: حدثنا الأعمش، عن إبراهيم، عن عابس بن ربيعة، عن علي رضي الله عنه قال: كل الطلاق جائز إلا طلاق المعتوه، فقال: هذا أحسن ما في أيدينا، وذهب إلى الأعمش فسأله عنه.

Aḥmad ibn Muḥammad informed us: Muḥammad ibn ʿAmr ibn ʿUthmān al-Khazzāz related to us: My father related to us: ʿAlī ibn al-Rukayn ibn al-Rabīʿ related to us, from his father, who said: I was with Abū Ḥanīfa when he was asked about divorce pronounced by an intoxicated person. He said, ‘Al-Haytham al-Ṣayrafī related to me, from ʿĀmir and Shurayḥ, that they both said: An intoxicated person’s divorce is valid.’ I said to him, ‘Al-Aʿmash related to us, from Ibrāhīm, from ʿĀbis ibn Rabīʿa, from ʿAlī—may God be pleased with him—who said: Every divorce is valid except that pronounced by a mentally impaired person.’ He said, ‘This is the best evidence we have,’ and went to al-Aʿmash to ask him about it.
