حدثنا عبد الله بن عبيد الله، قال: حدثنا محمد بن زياد الخواص الرملي، قال: حدثنا آدم بن أبي إياس العسقلاني، قال: حدثنا أبو الفضل، عن أبي يوسف، عن مغيرة، عن إبراهيم قال: ليس فيه حد ولا لعان، يعني في الرجل يقول لامرأته: لم أجدك عذراء، قال: لأن العذرة تذهب من الوثبة ومن الحمل الثقيل، قال أبو الفضل: وقال أبو حنيفة مثل ذلك، وقال: إنما هو شيء أخبرها ولم يقذفها، وهو قول أبي يوسف رحمة الله عليه.

ʿAbd Allah ibn ʿUbayd Allah related to us; he said: Muhammad ibn Ziyad al-Khawwas al-Ramli related to us; he said: Adam ibn Abi Iyas al-ʿAsqalani related to us; he said: Abu al-Fadl related to us, from Abu Yusuf, from Mughira, from Ibrahim; he said: There is neither a prescribed punishment nor mutual imprecation in it—meaning when a man says to his wife: I did not find you a virgin. He said: Because the hymen can be broken through a leap or carrying a heavy load. Abu al-Fadl said: Abu Hanifa said the same, and said: It is merely something he told her; he did not accuse her of unlawful intercourse. This is Abu Yusuf's position, may God have mercy on him.
