Then set the protected interval between them at a distance known not to harm the other.”

Related to us: Jaʿfar ibn Muḥammad; he said: related to us: Muḥammad ibn Naṣr ibn Saʿīd; he said: related to us: Ḥassān, who spoke: Concerning a man who owns land, around which people build houses, directing their roof gutters and the runoff of rainwater and other water from their houses onto that land, while the man is present and neither changes nor objects to it. He then wishes to build a house on his land or make it a garden, but the neighbours prevent him, saying: “It is the collecting place for our houses’ water, and you were present without changing or objecting.” Or he was absent, or the land previously belonged to someone else in that condition and he bought or inherited it. Ḥassān said: Abū Ḥanīfa and Sufyān said: “They have no right of drainage, gutter flow or anything else over the man’s land. He may have that diverted away from it whenever he wishes. Even if they did this on land belonging to someone else without any right they held over the land when they did it, he may have all of it diverted away from it.”
The printed switch of grammatical person in “he may have them divert” is expressed as causation; no drainage right is inserted into the negative condition.
